We came upon a group including kids walking on a section of downhill at Newcastleton today..Dave being the lead rider advised them that they shouldn't be on a mtb specific trail and upon reaching the fire road a discussion ensued regarding the freedom to roam act in Scotland as to wether they were allowed on mtb trails ..Dave upon reflection seemed to think that they were ..although best advice would be that they didn't . I was quite adamant that they were not when walking along the road came Fedora man walking his two dogs who decided (I thought quite pompously ) to throw in his two pennorth and tell me that walkers were allowed on mtb trails ..I told him to brush up on his knowledge as he quite clearly didn't have a clue he said he didn't need to as he was right ..I called him an idiot ..he said don't call me an idiot ..I said I would because he was ..at which point boredom set in and we cycled off . In retrospect I did regret my outburst ( kind of ) ..but it did get me thinking ..was he right ? Please tell me he wasn't ..as I would then feel obliged to take out a personal ad. ...apologising ..and offering to have his babies ...so this is one for our Scottish brothers to answer methinks

Neil I have had a quick search on the net and found that the Scottish access laws do no apply to the following "Land developed and in use for recreation and where the exercise of access rights would interfere with such use" not sure by if this includes MTB trails but I think it may well, so he was an idiot.

It also says that you must use the land responsibly, walking up a downhill traill is not using the land responsibly
